Nursing Home Abuse and Neglect

If we live long enough, lack family members or loved ones to take care of us, residing in a nursing home is an enviable reality. For most people the mere mention of a nursing home results in negative thoughts of abuse and neglect. The Chicago injury attorneys at Steinberg Burtker & Grossman have vast experience in handled these cases against nursing homes that frequently violate the care and dignity of senior citizens.

We have successfully prosecuted many cases where residents have drowned in bathtubs, strangled by improperly placed bed sheets, fractured a hip after their call button went unanswered, burned in their beds, ravaged by bedsores, malnutrition/dehydration, medications errors, physical and sexual abuse.

The Illinois Legislature passed into law the Nursing Home Care Act that establishes the rights of residents and the responsibilities of facilities to protect these individuals from nursing home abuse and neglect. The act provides a "bill of rights" which includes:

All residents have the right to remain free from abuse and neglect

All residents have the right to wear their own clothes and keep their personal belongings in their rooms

All residents have the right be cared for by their own doctor under their own health insurance or at their expense

All residents have the right to refuse treatment

All residents have the right be free from restraints, unless ordered by a physician to protect a resident

All residents have the right to visitors, phone calls and mail service

It is certainly desirable to publish this written law in our state but without an experience attorney to prosecute violations of the statute justice for Nursing Home residents will never be served.
